FLAT TRANSFER — SOCIETY PROCESS GUIDE
SELLER CHECKLIST
- [ ] Give 15 days written notice of intent to transfer to the Secretary
- [ ] All names on Index 2 must sign personally. Power of Attorney if any, copy must be submitted with the application.
- [ ] Clear all outstanding dues — society maintenance, electricity, property tax, gas pipeline etc.
- [ ] Submit original Share Certificate to society (if not procured, follow steps here to procure share certificate)
- [ ] Sign resignation form as member & transfer forms to induct buyer as new member (Forms 20/1, 20/2, 21, 22, 23)
- [ ] Pay transfer fee ₹600 and premium ₹25,000
BUYER CHECKLIST
- [ ] Submit membership application form (collaborate and fill with seller - Forms 20/1, 20/2, 21, 22, 23)
- [ ] Submit Aadhaar + PAN copy (self-attested) - all buyers as mentioned in Index 2
- [ ] Submit Index 2 copy (ensure stamp duty and registration amounts are correct)
- [ ] Submit any NOC format required under applicable law (bank, government, etc.) - note: society NOC is not mandatory for sale
- [ ] Sign application form (with seller) accepting all outstanding liabilities of seller towards society
DOCUMENTS BOTH PARTIES SUBMIT
- [ ] Index 2 copy
- [ ] Valid PAN + AADHAR of ALL sellers and buyers
WHAT HAPPENS NEXT
Secretary places application before next MC meeting → Committee approves or rejects within **3 months** → Share certificate transferred → New owner formally inducted as member
> If no decision is communicated within 3 months, transfer is **deemed accepted** automatically under Section 22(2) MCS Act.
IMPORTANT NOTES
- NOC from society is **not mandatory** for transfer. If needed by either party, apply separately; society must respond within 1 month
- For sale registrations **after 11 July 2017**: share certificate remains in original owner's name until transfer formalities are fully completed. New owner is not admitted as member until then
- Any transfer violating the Act, Rules, or Byelaws is **void**
